By accessing and using UseClick.io (the "Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Terms.description

UseClick.io is a link shortening and analytics platform that allows users to create shortened URLs, track click analytics, and generate reports. Our service includes:

• URL shortening with custom slugs
• Real-time click analytics and reporting
• Geographic and device tracking
• Dashboard for managing links
• Data export capabilities
• User authentication and account management

3. Terms.accounts

To use certain features of our Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding the password and for maintaining the confidentiality of your account. You agree not to disclose your password to any third party and to take sole responsibility for any activities or actions under your account.

4. Terms.acceptableUse

You agree not to use the Service to:

• Violate any applicable local, state, national, or international law or regulation
• Transmit or create links to content that is harmful, threatening, abusive, harassing, defamatory, vulgar, or otherwise objectionable
• Engage in any activity that could disable, overburden, or impair the proper working of the Service
• Create shortened links to malware, phishing sites, or other malicious content
• Spam or send unsolicited communications
• Infringe upon or violate our intellectual property rights or the intellectual property rights of others
• Attempt to gain unauthorized access to other user accounts or our systems
• Use the Service for any commercial purpose without our express written consent
• Create links to content that violates copyright, trademark, or other intellectual property laws
• Engage in any form of automated data collection without permission

5. Terms.content

You retain ownership of the original URLs and content you submit to our Service. However, by using our Service, you grant us a non-exclusive, worldwide, royalty-free license to use, copy, modify, and display such content solely for the purpose of providing the Service.

We reserve the right to review, monitor, and remove any links or content that violates these terms or is deemed inappropriate. We may suspend or terminate accounts that repeatedly violate our policies.

Shortened links remain active as long as your account is in good standing. We reserve the right to deactivate links that violate our terms or are inactive for extended periods.

6. Terms.payment

Some features of our Service require a paid subscription. Payment processing is handled securely through Stripe. By subscribing, you agree to pay all fees associated with your chosen plan.

Subscription fees are billed in advance on a recurring basis. Failure to pay fees may result in suspension or termination of your account.

Refunds are provided at our discretion and typically only for billing errors or service outages that significantly impact service availability.

7. Terms.ip

The Service and its original content, features, and functionality are and will remain the exclusive property of UseClick.io and its licensors. The Service is protected by copyright, trademark, and other laws.

8. Terms.privacy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices regarding the collection and use of your information.

9. Terms.availability

We strive to provide reliable service but cannot guarantee 100% uptime. We reserve the right to modify, suspend, or discontinue the Service at any time with or without notice. We are not liable for any modification, suspension, or discontinuance of the Service.

10. Terms.liability

In no event shall UseClick.io, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

11. Terms.indemnification

You agree to defend, indemnify, and hold harmless UseClick.io and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney fees).

12. Terms.termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.

13. Terms.governingLaw

These Terms shall be interpreted and governed by the laws of the jurisdiction in which UseClick.io operates, without regard to its conflict of law provisions.

14. Terms.changes

We reserve the right to modify these terms at any time. We will notify users of any changes by posting the new Terms and Conditions on this page and updating the "Last updated" date.

15. Email Capture and Lead Collection

Email Capture is an optional paid feature that lets a link owner show a consent form before a visitor reaches the destination, inviting the visitor to submit their email address. Addresses are collected only after the visitor gives explicit consent and confirms their address through a double opt-in email. Nothing is stored unless the visitor confirms.

When you enable Email Capture, you act as the data controller for the email addresses you collect, and UseClick.io acts only as a data processor that stores confirmed addresses and makes them available to you for export. You are solely responsible for establishing a lawful basis for collection, for how the collected emails are used, and for complying with all applicable laws, including the GDPR, CAN-SPAM, and other data protection and anti-spam regulations.

You must provide a valid contact address that is shown to visitors, maintain an accurate privacy notice, send only communications the visitor has agreed to receive, and promptly honor access, correction, unsubscribe, and deletion requests. You must not use Email Capture to collect addresses deceptively, to send spam, or for any unlawful purpose.

UseClick.io does not send marketing messages on your behalf and is not responsible for the content of, or your use of, any emails or data collected through this feature. Once you export collected addresses to any other system, that data is outside UseClick.io's control and is your sole responsibility. You agree to indemnify and hold UseClick.io harmless from any claim arising out of your use of Email Capture, including any failure to obtain valid consent or to comply with applicable law. A visitor may remove their address from UseClick.io's systems at any time using the unsubscribe link; removal from any system you have exported to is your responsibility.

16. Free Link Preview Page

Links created on free-tier accounts and served through the useclick.io domain are shown to visitors via a preview page before the visitor is forwarded to the destination. The preview page displays the destination hostname, a page title and image fetched from the destination, and an honest safety status based on automated checks performed at link creation. The visitor may proceed to the destination by clicking the continue button.

The preview page is not shown for links served on custom or branded domains, for links belonging to paid-plan accounts, or for links pointing to domains that UseClick.io has classified as trusted or that have been manually verified by our team.

A click is recorded when the visitor first arrives at the short link, before the preview page is displayed. This means click counts reflect the number of people who clicked the short link, not the number who subsequently proceeded to the destination. No additional personal data is collected on the preview page itself.
